FCC Eases Restrictions on Toy Drones – New Opportunities for Chinese Foreign Trade Exports to North America

At the end of 2025, the U.S. Federal Communications Commission (FCC) issued extremely stringent control policies that placed all overseas-manufactured drones and their core components on the national security control list, creating massive obstacles for Chinese toy drone factories and cross-border sellers exporting to the United States. Half a year later, on June 15, 2026, the FCC officially released Official Notice DA 26-588, issuing a major relaxation of regulations for low-threshold recreational toy drones. Models that meet the full set of standards may be removed from the national security control list even if fitted with foreign-made components. This marks the first consumer drone category to be exempted since the implementation of the strict round of controls.

This relaxation is not a unilateral FCC decision. It is primarily based on a security assessment conclusion issued by the U.S. Department of Defense on June 12: toy drones with only basic flight capabilities have inherent limitations in flight performance, data collection and remote control, and pose no substantial threats to U.S. national territory or public safety. Therefore, a dedicated exemption channel has been established exclusively for these products.

I. Exemption Eligibility Criteria

The new policy adopts a full-compliance review rule. Products will remain classified as controlled equipment and be ineligible for the exemption if they fail to meet any single parameter or configuration requirement. The 12 standards are grouped below for quick self-inspection by manufacturers and sellers:

(1) Mandatory Flight Performance Limits

  1. Maximum takeoff weight of the complete aircraft ≤ 150 grams

  2. Operation restricted to visual line-of-sight (VLOS); maximum remote control distance capped at 100 meters

  3. Maximum flight altitude shall not exceed 300 feet (approximately 91.4 meters)

  4. Maximum horizontal flight speed ≤ 10 meters per second

  5. Single-battery flight duration limited to less than 10 minutes

(2) Restricted Communication & Positioning Functions

  1. No built-in GPS, GNSS or other satellite positioning modules;  no automatic return-to-home, flight path planning or target tracking      functions

  2. Prohibited connection to Wi-Fi, mobile apps, cellular networks or the internet. Only dedicated 2.4G/5.8G RF communication between the      remote controller and drone is permitted. Band parameters are fixed and unmodifiable, and must comply with FCC RF specifications.

(3) Prohibited Hardware & Expandable Functions

  1. No cameras, microphones, real-time video transmission, onboard recording or any other image/audio capture sensors to eliminate surveillance and data collection capabilities

  2. No modular payload expansion ports on the airframe; no installation of drop devices, searchlights, FPV aerial photography lenses or other accessories

  3. Only brushed motors are allowed; brushless motors are strictly forbidden on all complete units

(4) Product Positioning & Enterprise Qualification Requirements

  1. The product shall be clearly marketed and labeled on packaging as a recreational toy

  2. The manufacturing entity is not included on the controlled entity blacklist under Section 1709 of the National Defense Authorization      Act (NDAA) for Fiscal Year 2025

Toy drones that satisfy all 12 standards do not require additional special national security exemptions. They only need standard FCC wireless RF certification to clear U.S. customs, significantly cutting audit costs and compliance risks for importers and cross-border merchants.

  1. Relief from supply chain restrictions and production cost pressures

This exemption also covers toy drones assembled with foreign components. Enterprises are not forced to replace parts with domestic alternatives to evade controls, enabling normal use of global supply chains and easing pressure on material allocation and manufacturing costs.

  1. New market expansion window in North America

As a pivotal turning point in drone control regulations, this targeted relaxation for low-end recreational toys creates a prime window for long-established toy factories and cross-border e-commerce sellers to launch new products, develop sales channels and stock overseas inventories.

III. Critical Compliance Reminders – Avoid Regulatory Violations

  1. Exemption does not equal zero supervision:Removal from the national security control list only waives national security-related bans. Toy drones remain radio frequency transmitting devices and must complet FCC RF certification. Uncertified products are prohibited from all sales      and distribution in the U.S. market.

  2. A "toy" label is not a universal exemption pass:Even if products are designed and advertised as toys, any unit equipped with aerial photography cameras, brushless motors, exceeding battery life limits, or supporting mobile phone connectivity will be classified as controlled equipment. Unauthorized export or sales will result in heavy FCC fines.

  3. High-performance consumer drones are excluded from this exemption:Professional aerial drones, long-flight models, payload-expandable drones and units with positioning/return-to-home functions remain subject to the original strict control rules and are not covered by the relaxed policy.

IV. Practical Implementation Suggestions for Export Enterprises

  1. Pre-product self-inspection:Cross-check complete aircraft parameters and hardware configurations against the 12 criteria to distinguish exempt models from controlled variants, and formulate separate export plans accordingly.

  2. Full-unit compliance testing:Cooperate with third-party laboratories holding official FCC TCB and CPSC authorization to conduct full-parameter conformity testing and obtain officially recognized test      reports.

  3. Complete all mandatory certifications simultaneously:In addition to FCC ID RF certification, complete North America-mandated certifications including ASTM F963 toy safety and UN38.3 lithium battery transportation safety.

  4. Enterprise qualification verification:Confirm in advance whether the company entity appears on the NDAA controlled entity list to avoid export blockages caused by entity eligibility issues.

The new FCC exemption policy for toy drones brings substantial favorable conditions for Chinese low-end recreational drone exports to the United States. However, the relaxed policy is paired with clear, strict technical red lines. Enterprises must not take chances. Early verification of product parameters and full completion of compliance certifications will allow businesses to seize policy dividends and steadily expand their presence in the North American consumer drone market.
